Mercoledì 10 Maggio 2017 è stato ratificato lo “Statuto dei lavoratori Autonomi” o “Jobs Act degli autonomi”, un disegno di legge che regola il lavoro autonomo non imprenditoriale assicurando tutele e diritti a oltre due milioni di lavoratori con partita iva.

La legge comprende 22 articoli che introducono importanti novità:

Tutte le condizioni contrattuali che permettono al committente di un lavoro di pagare professionisti e collaboratori coordinati oltre 60 giorni dallo svolgimento della prestazione sono ritenute nulle dall’entrata in vigore della legge

Il termine di 30 giorni viene applicato nei casi in cui il contratto non prevede una scadenza entro cui pagare.

Il provvedimento decreta che il contratto non può essere variato unilateralmente dal committente.

Infine i rimborsi spese erogati dal mandatario non partecipa più a formare il reddito imponibile del lavoratore autonomo.

Detrazione Spese per Corsi di Formazione

Le spese per master, corsi di formazione e convegni sono deducibili annualmente e integralmente fino a 10.000 euro.

Le somme dedicate ai servizi personalizzati di certificazione delle competenze, orientamento, ricerca e sostegno all’auto-imprenditorialità dovranno rispettare il tetto di 5.000 euro.

Sarà deducibile anche assicurazione contro il mancato pagamento delle prestazioni

Viene abrogata l’astensione obbligatoria dal lavoro in caso di maternità; la lavoratrice iscritta alla gestione separata dell’INPS riceverà all’indennità di maternità pur continuando a lavorare.

Il limite di durata del congedo parentale è esteso da tre a sei mesi e se ne potrà usufruire fino al terzo anno di vita del bambino.

Il nuovo ordinamento prevede anche per i padri iscritti alla Gestione separata la possibilità di richiedere il congedo.

Qualora entrambi i genitori si avvarranno dei trattamenti economici per congedo parentale, questi non devono superare complessivamente il limite di 6 mesi.

La norma è legittima anche in caso di adozione di un minore.

Le lavoratrici autonome iscritte alla gestione separata dell’INPS avranno diritto a un congedo parentale che aumenta da tre a sei mesi durante i quali potrà essere sostituita nel proprio lavoro da un collega che abbia le stesse competenze professionali.

La futura mamma, in accordo con il committente, potrà essere sostituita da una persona di fiducia in possesso delle medesime competenze professionali.

Gli istituti di previdenza privati potranno somministrare nuovi servizi oltre quelli già contemplati dalle attuali leggi; ad esempio, potranno stanziare forme di sostegno economico per i propri associati in difficoltà.

Una contribuzione aggiuntiva potrebbe essere introdotta dalle casse private per finanziare questi servizi. In ogni caso, un decreto legislativo del governo dovrà regolamentare l’introduzione di queste modifiche.

I collaboratori coordinati e continuativi avranno diritto a ricevere ricevere la “Dis-Coll”, introdotta nel 2015 in via sperimentale e oggi entrata in vigore in via definitiva.

Anche assegnisti e dottorandi di ricerca potranno richiedere l’indennità di disoccupazione versando lo 0,51 per cento in più di contributi.

Con questi termini vengono definite tutte quelle situazioni in cui il lavoratore subordinato svolga l’attività da casa. Se prima questa modalità era subordinata alle necessità della singola impresa, oggi viene invece regolata.

La prestazione lavorativa può avere luogo in parte all’interno dei locali aziendali e in parte all’esterno, senza una postazione fissa ed entro i limiti di durata massima dell’orario di lavoro. La retribuzione e le condizioni dovranno essere i medesimi dei lavoratori interni all’azienda che svolgono le stesse mansioni.

L’imprenditore o il lavoratore subordinato può estinguere unilateralmente il rapporto si smart working solo in seguito a un preavviso ristabilendo le condizioni lavorative ordinarie.
